1. Introduction

These Terms of Service ("Terms") govern your use of the Quit Yapping website and progressive web application available at quityapping.com (the "Service"), operated by QUIT YAPPING PTY LTD (ABN 14 695 505 189), a company registered in New South Wales, Australia ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Quit Yapping is an AI-powered tool that generates TL;DR summaries and key points from YouTube videos. You submit a YouTube URL and receive a summary generated by our AI system.

We also provide an Explore feed of pre-summarised content curated from public YouTube channels.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

4. Accounts

4.1 Sign-In

You may use the Service without an account (subject to usage limits) or sign in using Google OAuth. By signing in with Google, you authorise us to access your Google account name, email address, and profile picture as described in our Privacy Policy.

4.2 Your Responsibilities

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to notify us immediately at privacy@quityapping.com if you suspect unauthorised access.

4.3 Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time via the settings page.

5. Usage Limits

The Service operates under the following usage tiers:

All tiers are also subject to rate limits (5 requests per minute, 30 per hour) to maintain service availability for all users. These limits may change at any time with reasonable notice.

Free tier users are subject to a daily fair use limit. This limit is set generously and is intended solely to prevent automated abuse rather than to restrict genuine personal use.

6. Premium Access

6.1 Current State

Premium access is currently granted manually or via a 7-day trial on sign-up. Paid subscription billing is not yet active. When billing launches, registered users will be notified by email with full pricing details and at least 14 days' notice before any charges apply.

6.2 Planned Pricing

The Premium subscription is planned at $3.50 USD per month. Pricing is in US dollars. We reserve the right to adjust pricing before billing goes live.

6.3 Cancellation & Refunds

Once billing is active, you may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. We offer a full refund if requested within 7 days of your first payment. After 7 days, payments are non-refundable except where required by Australian Consumer Law (see Section 11).

7. Future Programs

We intend to introduce a referral program, loyalty discounts for long-term subscribers, and an Ambassador program for students and content creators. None of these programs are currently active. Terms will be published when each program launches.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Submit YouTube URLs for the purpose of infringing copyright or bypassing content restrictions
  • Attempt to reverse-engineer, scrape, or extract data from the Service
  • Use automated tools to generate summaries in bulk without our permission
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Use the Service to harass, harm, or discriminate against any person
  • Circumvent usage limits through multiple accounts, VPNs, or other technical means

We reserve the right to suspend or terminate accounts that violate these rules without notice.

9. Intellectual Property

9.1 Our IP

The Quit Yapping name, logo, design, and all original content on the Service are owned by QUIT YAPPING PTY LTD. You may not reproduce, copy, or distribute them without written permission.

9.2 AI-Generated Summaries

Summaries generated by the Service are produced by our AI system and are provided to you for personal use. You may share individual summaries with attribution to Quit Yapping. You may not use summaries for commercial purposes, resell them, or use them to train AI models without our permission.

9.3 YouTube Content

Summaries are derived from publicly available YouTube video transcripts. The underlying video content remains the property of the respective creators and YouTube. Quit Yapping does not claim ownership over source video content.

9.4 Your Content

You retain ownership of any content you submit to the Service (such as YouTube URLs). By submitting content, you grant us a limited licence to process it for the purpose of generating summaries.

10. Disclaimers

10.1 Accuracy

AI-generated summaries may contain errors, omissions, or inaccuracies. Summaries are provided for informational convenience only and should not be relied upon as a substitute for watching the original video, particularly for medical, legal, financial, or safety-critical content.

10.2 Service Availability

We do not guarantee uninterrupted or error-free access to the Service. We may perform maintenance, updates, or experience outages beyond our control.

10.3 Third-Party Content

The Service summarises third-party YouTube content. We do not endorse, verify, or take responsibility for the accuracy or legality of that content.

11. Australian Consumer Law

Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). If you are a consumer within the meaning of the Australian Consumer Law, you may be entitled to remedies that cannot be excluded by contract, including guarantees that services will be provided with due care and skill and be fit for purpose.

12. Limitation of Liability

To the maximum extent permitted by law, QUIT YAPPING PTY LTD's total liability to you for any loss or damage arising from your use of the Service is limited to the amount you paid us in the 3 months preceding the event giving rise to the claim, or $10.50 USD (three months of subscription), whichever is greater.

We are not liable for any indirect, incidental, consequential, or special damages, including loss of data, loss of revenue, or loss of profits.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, available at quityapping.com/privacy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

We use Google OAuth for sign-in. Data received from Google (name, email, profile picture) is used solely to create and manage your account and is handled in accordance with our Privacy Policy and Google's API Services User Data Policy.

14. Changes to These Terms

We may update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
